TERMS AND CONDITIONS FOR GUESTS, ZENFULCOVE (ELGIN TX)

1. INTRODUCTION
This document outlines the terms and conditions ("Terms") that apply to your stay at ZenfulCove ("the Property"), located at 103 Potato Smith Rd. Unit C, Elgin TX which is owned and operated by ZenfulCove LLC (“Owner”). By booking and staying at the Property, you ("the Guest") agree to comply with these Terms. Please read them carefully.
2. ACCEPTANCE OF TERMS
By confirming your reservation and staying at the Property, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not proceed with your reservation.
3. OCCUPANCY AND USE OF THE PROPERTY
3.1 Authorized Occupants: Guest agrees that no more than the guests listed in the reservation shall be permitted on the Property at any time during the Rental Term, all of whom shall comply with the conditions and restrictions imposed upon Guest under this Agreement. No Pets allowed. Unless agreed by the Owner.
3.2 Use of the Property: The Property is to be used solely for residential purposes. No commercial activities, parties or large gatherings are allowed without prior written consent from the Owner.
3.3 Noise: Guests are required to observe quiet hours from 10:00 PM to 7:00 AM. During this time, noise levels must be kept to a minimum to respect the neighbors. Guests shall refrain from loud noise, loud music and shall not disturb, annoy, endanger, or inconvenience neighbors, nor shall Guest use the Property for any immoral, offensive or unlawful purposes, nor commit waste or nuisance on or about the Property.
3.4 SECURITY AND MONITORING
Cameras: For the safety and security of both Guests and the Property, there are cameras installed at the entrances of the units and on the streets. These cameras are used to monitor entry points and common areas and do not record inside any private living spaces. By staying at the Property, the Guest consents to the use of these security cameras. This clause ensures transparency about the use of cameras and reinforces the safety measures in place.
4. POND AND WILDLIFE
4.1 No Swimming in Pond: Guests are strictly prohibited from swimming in the pond. This restriction is for your safety and to preserve the natural habitat. There is no life guard on duty.
4.2 Kayaking / Canoeing allowed but Tenants and their guests agree they MUST WEAR LIFE JACKETS. THERE ARE LIFE JACKETS PROVIDED BY ZENFULCOVE (FOUND IN THE BOX NEAR THE CANOE).
4.2 Fishing: Guests are allowed to fish in the pond under a catch-and-release policy. Any fish caught must be returned to the water.
4.3 Wildlife: The Property may have various forms of wildlife. Guests acknowledge that interaction with wildlife is at their own risk, and the Owner is not responsible for any harm, injury, or damage caused by wildlife encounters.
5. RELEASE OF LIABILITY
5.1 General Liability: Guest hereby agrees to indemnify and hold harmless Zenfulcove LLC and their agents, owners, successors, employees and contractors from and against any costs, damages, liabilities, claims, legal fees and other actions for any damages, costs, attorneys fees incurred by Guest, permitted guests, visitors or agents, representatives or successors of Guest due to any claims relating to destruction of property or injury to persons or loss of life sustained by Guest or family and visitors of Guest in or about the Property and Guest expressly agrees to save and hold Zenfulcove LLC harmless in all such cases.
5.2 Limitation of Liability: To the maximum extent permitted by applicable law, in no event shall Zenfulcove LLC its affiliates, directors, employees, or agents be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, revenue, data, or goodwill, arising out of or related to the use of or inability to use the services. The total aggregate liability of Zenfulcove LLC, whether in contract, tort, or otherwise, shall not exceed the amount actually paid by the customer for the services giving rise to the claim.
5.3 CAMP Fire – Because we live in a very wooded area, we only allow CAMP fires to be built in the designated areas. Fires must be monitored at all times and completely out before guests leaves fire. Bastrop county will occasionally send out a Burn ban due to no rain in the area. If there is one in effect, Guest agrees to follow the rules.
6. RISK OF LOSS
Guest agrees that all personal property, furnishings, personal affects and other items brought into the Property by Guest or their permitted guests and visitors shall be at the sole risk of Guest with regard to any theft, damage, destruction or other loss and Rental Agent shall not be responsible or liable for any reason whatsoever.
7. RELEASE
Guest hereby waives and releases any claims against The Property, Rental Agent, the Property owner and their successors, assigns, employees or representatives, officially or otherwise, for any injuries, bodily injuries or death that may be sustained by Guest on or near or adjacent to the Property, including any common facilities, activities or amenities. Guest agrees to use any such facilities or amenities entirely at the Guest’s own initiative, risk and responsibility.
8. CONDITION AND USE OF PROPERTY
Rental Agent shall use its best efforts to ensure the operation of all amenities in the Property, such as internet access. Rental Agent shall not be held responsible for such items failure to work, but will make every effort to correct any issues as reported as quickly as possible.
9. PROPERTY RULES
9.1 Compliance: The Guest agrees to comply with all Property rules, including those posted within the Property and communicated by the Owner which are also made part of this agreement. Any violation of these rules may result in immediate termination of the stay without refund.
9.2 Guest acknowledges that use of amenities such as outdoor tubs, saunas, canoeing, and the like may be potentially dangerous and involve potential risks if improperly used, and are at the Guest’s own risk.
9.3 Guest shall use the Property for residential purposes only and in a careful manner to prevent any damage or loss to the Property and keep the Property in clean and sanitary condition at all times.
9.4. DAMAGES AND SECURITY DEPOSIT
Damage to Property:
Guests are expected to exercise care and take all necessary precautions to avoid causing damage to the property. The Guest assumes full responsibility for any damage caused
during the stay, including damage caused by the Guest, their visitors, agents, or any individuals under the Guest's supervision.
Guests are strictly prohibited from affixing items to the floors, walls, or ceilings using nails, screws, tape, drawing pins, or any other methods, unless prior written consent is obtained from Zenfulcove LLC. Any damage resulting from such actions will incur charges equivalent to the full cost of repair or replacement.
Zenfulcove LLC reserves the right to request additional security measures, including the collection of a security deposit, to cover potential damages.
No Smoking Policy
Smoking or vaping is strictly prohibited in guest rooms and cabin. Guests found in violation of this policy will be charged a $600 cleaning and abatement fee to restore the space to a smoke-free condition.
A standard cleaning fee is included with your booking; however, if the space is left in an unusually dirty condition, an additional fee of up to $200 may apply. This includes:
– Excessive trash or food waste
– Glitter or craft materials
– Mud, Sand tracked indoors
– Uncleaned spills or bodily fluids
Age Restriction: Guests must be at least 21 years old to make a reservation. The property is not liable for any issues or responsibilities arising from misrepresentation of age.
10. CANCELLATION POLICY
10.1 Cancellation by Guest: Cancellations must be made in accordance with the cancellation policy outlined on the platform the reservation was made on. Refunds, if any, will be processed according to the terms specified at the time of booking.
10.2 Cancellation by Owner: The Owner reserves the right to cancel the booking in the event of unforeseen circumstances, such as natural disasters, or unexpected repairs which render the Property unsafe or uninhabitable. In such cases, refunds shall be refunded according to the policy provided by the rental platform.
11. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the state of Texas County of Bastrop. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in that state.
12. SEVERABILITY If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
13. ENTIRE AGREEMENT These Terms constitute the entire agreement between the Guest and the Owner regarding the Guest’s stay at the Property and supersede any prior agreements or understandings, whether written or oral.
14. AMENDMENTS
The Owner reserves the right to amend these Terms at any time. Any amendments will be communicated to the Guest, and continued occupancy of the Property will constitute acceptance of the amended Terms.
